1. Privacy Policy

1.1 Introduction

Trcoms LTD ("Trcoms", "we", "us") provides managed hosting and infrastructure services. We process personal data in accordance with:

  • UK General Data Protection Regulation (UK GDPR)
  • Data Protection Act 2018
  • Privacy and Electronic Communications Regulations 2003

1.2 Data Controller

Trcoms LTD acts as Data Controller for account and billing data. Where hosting client systems, Trcoms acts as Data Processor.

1.3 Data Collected

  • Account and contact information
  • Billing information
  • Technical logs and server metadata
  • Support communications

Trcoms does not access or process hosted application data unless required for support, security, or legal compliance.

1.4 Lawful Basis

Processing is based on contractual necessity, legal obligation, legitimate interests, or consent (where required).

1.5 Data Security

Security measures include:

  • Encrypted connections (SSL/TLS)
  • Access control restrictions
  • Infrastructure firewalls
  • Monitoring systems
  • Secure data centre environments

1.6 Data Retention

  • Financial records: retained for 6 years
  • Account records: retained for service duration
  • Server data: governed by Hosting Terms

1.7 Data Subject Rights

Individuals may request access, correction, erasure, restriction, portability, or lodge complaints with the Information Commissioner's Office (ICO).

2. Data Ownership & Sovereignty Policy

2.1 Ownership

All hosted data remains the exclusive property of the Client.

2.2 No Commercial Exploitation

Trcoms shall never:

  • Sell client data
  • Profile or mine client data
  • Use data for advertising
  • Share data with third parties except as legally required

2.3 Dedicated Infrastructure

Where dedicated servers are provisioned:

  • Resources are exclusive to the Client
  • No data sharing with other customers
  • Logical and technical isolation is enforced

2.4 Data Sovereignty

Clients retain full control over their data. Data location is disclosed transparently. Cross-border transfers occur only with appropriate legal safeguards.

3. Hosting Terms & Conditions

3.1 Agreement

By purchasing services, the Client agrees to be legally bound by these Terms.

3.2 Services

Managed hosting services include server provisioning, monitoring, security configuration, and backups as defined in the selected plan.

3.3 Fees

  • Fees payable monthly in advance unless agreed otherwise
  • VAT applied where applicable
  • Invoices due by stated date

3.4 Non-Payment Policy

If payment is not received:

  • Service may be suspended after 7 days
  • After 30 days of non-payment, the server shall be permanently suspended
  • All data may be irreversibly deleted without further notice

Trcoms bears no liability for data loss due to non-payment. Clients are responsible for independent backups.

3.5 Acceptable Use

Clients must not use services for unlawful activity, malware distribution, infringement, or prohibited content. Immediate suspension may occur upon breach.

3.6 Limitation of Liability

Nothing excludes liability for death, personal injury, fraud, or statutory non-excludable liability. Total liability shall not exceed fees paid in the preceding 3 months.

3.7 Governing Law

Governed by the laws of England and Wales. Exclusive jurisdiction: Courts of England and Wales.

4. Service Level Agreement (SLA)

4.1 Uptime

Target uptime: 99.9% monthly availability (excluding scheduled maintenance).

4.2 Support Response Times

  • Business Plans: 24–48 hours
  • Growth Plans: Same-day response
  • Enterprise Plans: 4–8 hours

4.3 Maintenance

Scheduled maintenance may occur with reasonable notice.

5. Backup & Disaster Recovery Policy

  • Backups provided as per service plan
  • Backups are not guaranteed as sole recovery method
  • Clients remain responsible for independent backup copies
  • Disaster recovery procedures available for Enterprise plans

6. Information Security Policy

Trcoms maintains:

  • Role-based access control
  • Security monitoring and alerting
  • Regular patch management
  • Incident response procedures
  • Secure credential management

7. Incident Response Policy

In the event of a security incident:

  • Immediate investigation
  • Containment measures
  • Notification to affected clients where legally required
  • Documentation and remediation

8. Data Processing Agreement (Summary Clause)

Where Trcoms acts as Data Processor:

  • Processing occurs only on documented instructions
  • Confidentiality obligations apply
  • Appropriate security measures implemented
  • Sub-processors engaged only with safeguards
  • Assistance provided for data subject rights

A full DPA may be executed for enterprise or government clients.

9. Acceptable Use Policy (AUP)

Prohibited activities include:

  • Illegal content hosting
  • Spam distribution
  • Denial-of-service attacks
  • Cryptocurrency mining without permission
  • Intellectual property infringement

Violation may result in immediate suspension.

10. Termination Policy

Clients may terminate with written notice. Outstanding fees remain payable. Data export must be requested before service termination and before deletion following non-payment.
